哈喽大家好，我是小K君，今天我们要讲的内容是：“什么是区块链+司法取证”？

司法取证是区块链已经落地的应用场景之一。可能有不少小伙伴会比较疑惑，区块链和司法取证能有什么关系？两者完全八竿子打不着啊。但区块链技术却可以解决司法流程中证据真实性的问题。

我们都知道，证据收集是司法审判中的重要一环，而证据的有效性主要从三个要素进行评估，真实性、关联性、合法性。其中真实性又是重中之重，可问题来了，在黑科技泛滥的今天，如何才能证明证据的真实性呢？

比如照片，可以通过p图软件进行修改，录音也可以通过调音的方式进行伪造。这就造成，在法院诉讼的过程中，千辛万苦获取到的证据，可能因为律师的一句质疑，而不了了之。所以，证明证据有效性的最大难点，就是需要事先证明证据是没有被篡改过的。

而不可篡改不正是区块链的特点之一嘛？区块链的本质是一个分布式的去中心化数据库，一旦数据上链，就会被链上的各个节点进行备份，想要对这个数据进行修改，就必须攻破全网50%以上的节点，这就决定数据是极难篡改的，刚好解决了证据的不可篡改性的问题。

但这还不能彻底说明证据是有效的，因为区块链技术虽然可以确保证据在存储的过程中不可篡改，却无法对存证数据本身的真实性作出担保。

于是，各区政府干脆上线了区块链技术的取证APP，大家可以在里面实现录音、录像、拍照等取证行为，证据会通过平台直接生成，并传递到区块链上进行备份，上传后，这个文件会通过区块链的加密算法进行加密，任何人可以拿着这份文件到区块链平台进行校验，来确认这份文件是否被篡改过。进而使任何人都不能在取证过程中造假，从源头解决了证据是否真实的问题。

目前，我国最高人民法院在关于互联网法院的规定中，将区块链识别为证据收集、固定和防篡改技术手段，确立了区块链存证运用的合法性，此外北京、深圳、杭州等地区，均上线了相关的区块链取证平台，为广大的执法人员提升了固证效率，相信随着区块链技术在司法领域的应用，可以带来一个更加公平、公正的新互联网世界。
